Définition

A person or entity entitled to receive benefits — income, principal, or both — from a trust, estate, insurance policy, or account.

The beneficiary is the party a trust ultimately exists to serve. Trust documents typically distinguish between current beneficiaries (those entitled to income or distributions now) and remainder beneficiaries (those who receive whatever is left after prior interests expire, often at a future date or upon a triggering event). A single individual can hold both roles simultaneously under different circumstances.

Beneficiary rights vary enormously depending on trust design. A discretionary beneficiary has no guaranteed right to distributions — the trustee decides whether and how much to distribute, guided by standards written into the document (such as "health, education, maintenance, and support"). A mandatory beneficiary is entitled to distributions on a fixed schedule or formula. Understanding which type of interest a beneficiary holds matters for everything from creditor protection to financial planning.

A common point of confusion is equating beneficial interest with legal ownership. The grantor transferred assets to the trust; the trustee holds legal title; the beneficiary holds the equitable interest — the right to benefit. These three roles can overlap (a grantor can be a beneficiary of a revocable trust) or be entirely separate.
