HEMS Standard (HEMS)

Definizione

A trustee distribution standard limiting payouts to a beneficiary's health, education, maintenance, and support — an IRS-recognized phrase that also limits a beneficiary's creditor exposure.

HEMS stands for Health, Education, Maintenance, and Support. When a trust document restricts distributions to these four purposes, it creates what planners call an "ascertainable standard" — a phrase the IRS recognizes as objective enough that the beneficiary is not treated as owning the trust assets for estate tax purposes. That distinction can be critical for keeping assets out of a beneficiary's taxable estate.

The HEMS standard also provides a degree of creditor protection. Because a beneficiary cannot demand distributions beyond these defined purposes, creditors generally cannot compel the trustee to make distributions either. A hypothetical beneficiary going through a divorce or business dispute may find that a HEMS-limited trust is more insulated than a trust with purely discretionary language — though outcomes depend heavily on state law.

A common confusion is treating HEMS as narrow. Courts have interpreted "maintenance and support" broadly to include a beneficiary's accustomed standard of living, meaning a trustee may legitimately make substantial distributions. HEMS is not a poverty test. It is also sometimes confused with a purely discretionary distribution standard, which gives trustees even wider latitude but sacrifices the ascertainable-standard tax protection. A qualified attorney should draft and interpret HEMS language carefully.
