Lifetime Exemption

Definição

The cumulative amount a person may transfer by gift during life or bequest at death — combined — before federal transfer taxes apply; the amount is set by law and subject to change.

The lifetime exemption is the central shield in the federal transfer-tax system. It is "unified" in the sense that it covers both lifetime gifts subject to the gift tax and transfers at death subject to the estate tax — the two draw from the same single pool. Every taxable gift made during life reduces the exemption available at death. Once the exemption is exhausted, transfers are taxed at rates set by law. The exemption amount has changed substantially over time and may change again; families should verify the current figure with a qualified estate attorney or CPA.

For families at the wealth levels explored across this site, understanding how much of the exemption remains — and whether to use it now versus preserve it for death — is a recurring planning question. A hypothetical entrepreneur who made large taxable gifts to an irrevocable trust years ago may have little remaining exemption, making further lifetime transfers more costly. Conversely, a family that has made no taxable gifts may hold a substantial unused exemption that could be deployed before law changes reduce it.

A nuance worth understanding: assets transferred using the lifetime exemption during life generally do not receive a step-up in basis at the donor's death, unlike assets held until death. This income-tax trade-off is a central tension in transfer planning and requires careful modeling. Families at higher wealth levels, such as those considering strategies outlined at wealth at $250 million, often work with coordinated legal, tax, and financial teams to evaluate this balance.
