Interfacetaal

Definitie

The legal jurisdiction — typically a U.S. state or foreign country — whose laws govern a trust's administration, validity, and taxation.

Situs (Latin for "place") determines which state's trust laws apply to a given trust. This matters enormously because state trust laws vary widely: some states offer longer permissible trust durations, stronger creditor protection, more flexible decanting rules, or no state income tax on accumulated trust income. A trust's situs is not automatically the state where the grantor lives — it can often be deliberately chosen or later changed.

For families with substantial wealth, selecting a favorable situs can be a meaningful planning decision. A hypothetical family in a high-income-tax state might establish a trust governed by the laws of a state with no trust income tax, potentially allowing income to accumulate without state-level drag — though the rules are technical and depend on factors such as where trustees and beneficiaries reside.

A common confusion is treating situs as fixed. In many cases, trustees can move a trust to a new jurisdiction by changing the trustee's location or through a formal court or administrative process. This flexibility is one reason situs receives close attention as laws and family circumstances evolve. A qualified attorney must evaluate whether a particular situs change is permissible and beneficial for any specific trust.
